Student Data Privacy Agreements

Protecting our Students, One Agreement at a Time.
District staff members are encouraged to research and utilize online services or applications to engage students and further the district's education mission. However, before any online service or application is purchased or used to collect or store confidential or critical information the Informaton Security Officer (ISO) or designee must approve the use of the service or application and verify that it meets the requirements of the law and Board policy and appropriately protects confidential and critical information. This prior approval is also required when the services are obtained without charge.

What does a Data Privacy Agreement do?
- It gives Pattonville direct control over the student record so we can be FERPA compliant.
- It identifies what data the vendor collects and the how they protect the data.
- It contains provisions for data collection, data sharing, data storing, data de-identification, and deletion of data.
- It defines procedures to be followed in the event of a data breach.
- It binds successors to same agreement when a company is bought/sold.
Definitions to Know
- PII - Personally Identifiable Information or any information that can be used to identify a person, even when combined with other known data or context.
- NDPA or DPA - refers to Student Data Privacy Agreements (the N is for National)
How do I know if digital resource is okay to use with students?
If you answer YES to any of these questions, please consult with your building DTS before using a new digital resource with students or before asking students to create their own account:

Does the student need to create an account and click a box to agree to Terms of Service?

Does it allow students to sign in without Pattonville setting up a Single-Sign-On option (e.g. in Canvas, Clever, or the Google Apps menu)?

Will the student produce content in the platform or be scored/evaluated within the platform?

Can the student interact with others on the platform?

Do the terms of service have an age requirement that your students do not meet?
